Privacy Policy

This Privacy Policy (the "Policy") explains how Cadient, LLC ("us," "our," or "we") collects, uses, discloses, and protects personal information that we collect (i) from users of our website, https://cadient.ai/ and any other websites and online services that we operate and that include a link to this Policy (collectively, the "Websites"); and (ii) from authorized users of business organizations that have contracted with us (our "Customers") to use our web-based applicant tracking system and other software applications (the "Applications"), for example, hiring managers and human resources staff of one of our Customers to whom the Customer provides access to the Applications.
The products and services that we provide to our Customers, including the Applications, may cause us to receive, collect, use, disclose, or otherwise process personal information relating to other individuals on behalf of and at the direction of those Customers, such as information related to job applicants that use the Applications to submit applications for employment with our Customers, and new hires of those Customers that submit their personal information through our Applications as part of our Customers' onboarding processes. That information is not subject to this Policy. Instead, we process that information at the direction of, and pursuant to our agreements with, those Customers. Under those agreements, we act as a service provider to our Customers, and they determine the purposes and means of the processing of that information. For more information about how we collect and use that information, please see the Services Privacy Notice that we make available within the Applications. If you have further questions about the handling of personal information that our Customers process using our Applications, please contact the relevant Customer directly.
Information We Collect
Information that you provide directly: When you use or access the Websites, or use the Applications as an authorized user of one of our Customers, we may collect personal information directly from you, such as the following:
- Contact information, such as your name, email address, or phone number.
- Business information, such as your job title and the name of your employer or organization.
- Registration and account information, including your username and password.
- Information you submit through the "Careers" section of the Websites, including professional and employment-related information and education information, such as your resume, cover letter, employment history, and any other information you provide in your employment inquiries or applications.
- Any other information you submit when you contact us through the Websites or Applications, including any information you provide in connection with support requests, enter into forms that we make available through the Websites or Applications.
Information we collect automatically: We also may collect certain other information automatically when you visit the Websites, or use the Applications as an authorized user of one of our Customers, such as the following:
- Browser and Device Information. Certain information is automatically collected by most websites, such as information about your device and your browser. For example, we may receive device identifiers such as IP address and MAC address, operating system type and version, and Internet browser type and version.
- Information Stored in Cookies. The Websites and Applications may also use cookies to collect personal information. Cookies are pieces of information stored directly on users' computers or devices. Cookies allow us to collect information such as browser type, time spent on the online services, pages visited, referring URL, and other traffic and usage data. We may also use cookies for purposes such as determining what features interest our users and revising our site features or operations.
- Pixel Tags/Web Beacons. The Websites and Applications may also use other tracking technologies to collect information when you use the Websites and the Applications. For example, pixel tags, sometimes called web beacons, are similar in function to a cookie and can tell us certain information like what content has been viewed.
- Activity Reporting and Log Data. We may receive log information related to your activities while using the Websites and the Applications, such as the pages that you view and the links that you click. In addition, we use Google Analytics to help us analyze how visitors use the Websites and Applications. Google Analytics uses cookies to collect information about your use of the Websites and the Applications, including your IP address. If you so choose, you may be able to opt out of Google Analytics by turning off cookies in the preferences settings in your browser. - Location Information. When you use the Websites and the Applications, we may receive information about your approximate location, or data that indicates your approximate location, such as your IP address.
In addition, when you visit and use the Websites, other parties may use cookies and other tracking technologies to collect personal information about your online activities over time and across different websites, applications, and other online products or services, including for analytics and interest-based advertising.
How We Use Your Information
We may use personal information that we collect about you for purposes that include the following:
- Providing the Websites and the Applications and supporting the features available to you and our Customers.
- Personalizing your experience on the Websites and Applications, such as enhancing features and designing relevant alerts, and delivering relevant advertising content.
- Conducting research to understand how you and our Customers use the Websites and the Applications and to determine what features and services may interest you and our Customers.
- Developing and improving the Websites and the Applications.
- Operating and improving our organization and our services.
- To communicate with you, including to send you marketing and promotional messages, and to respond to your inquiries and requests.
- To provide promotional content on our Websites and other third-party websites.
- For our own recruitment and hiring purposes, including evaluating and communicating with you about your employment application by email or SMS text message, and responding to related inquiries submitted through the Websites.
- Troubleshooting, de-bugging, and otherwise addressing issues that may arise with the functionality of the Websites and the Applications.
- Protecting the legal rights, property, safety, and security of records or information, our Customers and users, and our organization and others, including detecting and preventing fraud, misuse of the Websites and the Applications, and other unauthorized activity.
- Complying with applicable law, judicial process, any properly authorized civil, criminal, or regulatory investigation, or any subpoena or summons issued by a competent authority.
- Enforcing our policies, terms of use, or rights arising from contracts.
- Evaluating or participating in an actual or potential merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, including as part of bankruptcy, liquidation, or similar proceedings.
- For such other purposes as you may authorize at the time you submit the information.
- We also may aggregate or de-identify personal information we collect through the Websites and the Applications by removing any details that identify you personally. Aggregated or de-identified information will not be subject to this Policy and may be used and disclosed for any lawful purpose.
With Whom We Share Your Information
We may disclose your personal information:
- To our contractors, service providers, and other third parties we use to support our organization, which may include support of any of the data uses described above.
- To our third-party partners who resell our products and services and/or provide value-added services, or with whom we jointly offer products or services.
- To third-party advertising networks and websites, so that we can market and advertise on third-party platforms and websites.
- With respect to information collected from authorized users of our Applications, to the Customers with whom those users are associated.
- To comply with applicable law, other legal requirements, and industry standards.
- To enforce our policies, terms of use, contracts, or other legal rights.
- To investigate or prevent unlawful activities or misuse of the Websites or Applications.
- To protect against malicious, deceptive, fraudulent, or illegal activity, and participating in any prosecution or enforcement of laws or agreements meant to prevent or punish such activity.
- To operate, evaluate, debug, identify and repair errors, effectuate similar functional enhancements, and improve our Websites, Applications, or other services.
- To protect the legal rights, property, safety, and security of us, our users, our employees, and others.
- To an actual or potential buyer, successor, or other organization in the event of an actual or potential merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer.
We also will disclose information for any purpose or to any organization that you authorize or permit, such as when we request your consent to share information and you agree.
Data Retention Policy
Cadient Applicant Tracking System ("ATS") data will be retained for a period of three (3) years from the date of a candidate's application or until the termination of the customer's agreement with Cadient, whichever occurs first ("Retention Period").
At the end of the Retention Period, candidate application data that is not marked as "Hired" or "Terminated" within the ATS will be permanently deleted on a rolling daily basis. Candidate applications with a status of "Hired" or "Terminated" will be retained for the duration of the customer's agreement term.
Please note that once candidate data has been deleted, it cannot be restored or accessed in any manner.
For customers located in California, applicant data will be retained for four (4) years in compliance with applicable state law.
Your Rights and Choices
We provide you with choices with regard to your information. For example, you may choose not to provide the personal information we request through the Websites and Applications. However, not providing information we request may restrict your ability to use certain features of the Websites and Applications.
You may also be able to restrict the automatic collection of information when you use the Websites or Applications by disabling cookies in your internet browser, but doing so may prevent you from using the functionality of the Websites or Applications.
Some Internet browsers have a "do-not-track" feature that lets you tell the Websites or Applications that you do not want to have your online activities tracked. At this time, the Websites and Applications do not respond to browser "do-not-track" signals.
For information about interest-based advertising, and to opt out of this type of advertising by third parties that participate in self-regulatory programs, please visit the Network Advertising Initiative (NAI) opt out tool (networkadvertising.org/choices) and/or the Digital Advertising Alliance (DAA) Self-Regulatory Program for Online Behavioral Advertising (youradchoices.com). Please note that any opt-out choice you exercise through these programs will apply to interest-based advertising by the third parties you select, but will still allow the collection of data for other purposes, including research, analytics, and internal operations. You may continue to receive advertising, but that advertising may be less relevant to your interests.

Children
The Websites and Applications are not intended for use by children under the age of 13, and we do not knowingly collect personal information from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided personal information to Cadient, please contact us to make efforts to delete that information from our databases.
Third-party Links
The Websites or Applications may include links to other websites, applications, information, and services provided by third parties. We are not responsible for the privacy policies or practices of those third parties. We encourage you to review the applicable privacy policies of such third parties if you elect to follow the links provided.
Our Worldwide Practices
We operate internationally, and when you use the Websites and the Applications your personal information may be received in or transferred to locations outside the jurisdiction in which you are located. The data protection laws in these locations may differ from the jurisdiction where you are located and may not provide the same level of protection compared to the laws in the jurisdiction in which you are located.
Changes to this Policy
We may update this Policy to reflect changes in our privacy practices at any time. When we do so, we will update the Effective Date of the Policy, above. We encourage you to periodically review this Policy for the latest information on our privacy practices.
